This Acceptable Use Policy ("AUP") sets out the rules governing your use of the private VPN service ("Service") provided by Layer 9 Solutions Ltd ("we," "us," or "our"). This AUP forms part of and must be read alongside our VPN Terms of Use. Capitalised terms not defined here have the meanings given in the VPN Terms of Use. By using the Service, you agree to be bound by this AUP in full.
We provide the Service to support lawful, private, and secure internet use. We take a firm and uncompromising approach to misuse. Violations of this AUP will result in immediate account suspension or termination without refund and, where appropriate, reporting to law enforcement.
1. Permitted Uses
You may use the Service to:
- Protect your internet traffic on public or untrusted networks
- Maintain your privacy and prevent tracking by third parties
- Access geo-restricted content on streaming platforms and websites
- Secure remote access to your own systems and business networks
- Conduct legitimate security research on systems you own or have explicit written authorisation to test
- Browse and communicate in an encrypted manner for personal or business purposes
2. Prohibited Activities — Absolute Prohibitions
The following are absolutely prohibited regardless of intent, claimed purpose, or jurisdiction. These activities will result in immediate account termination, permanent banning, and mandatory reporting to the relevant law enforcement authorities:
- Accessing, distributing, transmitting, or facilitating access to child sexual abuse material (CSAM) or any content that sexually exploits or endangers minors — this will be reported to the National Crime Agency (NCA) and the Internet Watch Foundation (IWF) immediately and without warning
- Planning, facilitating, funding, or executing terrorist acts or acts of political violence against any government, organisation, or individual
- Creating or distributing malware, ransomware, spyware, trojans, keyloggers, rootkits, or any other software designed to cause harm, gain unauthorised access, or facilitate criminal activity
- Using the Service to conduct or facilitate human trafficking, slavery, or exploitation of any kind
3. Prohibited Activities — General
The following activities are prohibited and will result in suspension or termination of your account:
- Conducting or facilitating denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against any target, whether individual, corporate, or government
- Engaging in port scanning, network probing, vulnerability scanning, or any form of reconnaissance against systems you do not own or have explicit written authorisation to test
- Gaining or attempting to gain unauthorised access to any computer system, network, database, or device
- Sending unsolicited bulk email (spam), operating an open mail relay, or using the Service in connection with any email marketing not complying with applicable anti-spam legislation
- Engaging in phishing, spear-phishing, smishing, vishing, or any other form of social engineering against third parties
- Conducting identity theft, fraud, or financial crime of any kind
- Infringing the copyright or other intellectual property rights of third parties, including the unauthorised downloading, sharing, or streaming of copyrighted content via peer-to-peer networks or torrent clients
- Operating Tor exit nodes, I2P exit nodes, open proxies, or anonymous relay services through our infrastructure
- Mining cryptocurrency using our network or server resources
- Participating in botnets, click fraud, or any automated abuse of third-party services
- Harassing, stalking, threatening, or intimidating any individual or group
- Distributing or hosting content that incites violence, terrorism, racial hatred, or discrimination contrary to UK law, including the Online Safety Act 2023
- Reselling, sublicensing, or sharing your VPN access credentials with third parties not authorised under your account plan
- Circumventing, tampering with, or attempting to interfere with the technical controls, rate limits, or security mechanisms of the Service
- Using the Service to violate any applicable sanction regimes, export control laws, or embargoes
4. Fair Use Policy
The Service is provided for personal and business use. We operate a fair use policy to ensure consistent quality for all customers:
- Bandwidth-intensive activities (such as 24/7 4K streaming, continuous large file transfers, or automated bulk downloading) that consistently consume the majority of your allocated bandwidth may be subject to rate limiting
- Running servers, bots, or automated processes through the Service that generate disproportionate load on our infrastructure is not permitted without prior written agreement
- We reserve the right to throttle connections or contact you to discuss an upgrade if your usage materially impacts the quality of service for other customers
We will make reasonable efforts to contact you before imposing ongoing restrictions where your usage does not constitute a clear policy violation.
5. No-Log Policy and Law Enforcement
We operate a strict no-log policy as detailed in our VPN Privacy Policy. We do not retain connection logs, traffic logs, DNS query logs, or any data that would identify your online activity while using the Service.
However, we will cooperate fully with law enforcement authorities where we are legally required to do so and where valid legal process (such as a court order or production order under the Investigatory Powers Act 2016) is served. In such cases, we will disclose any account registration data we hold. The no-log policy means we have no traffic or connection data to provide, but account-level data (name, email, billing address, payment records) may be disclosed.
Where we identify clear evidence of serious criminal activity (such as CSAM or terrorism), we will proactively report this to the relevant authorities without waiting for a formal legal order.
6. Monitoring and Enforcement
We do not monitor the content of your internet traffic as a matter of course. However, we may monitor aggregate network behaviour (e.g., traffic volume, port usage patterns, abuse reports from third parties) to identify potential violations of this AUP. Where we receive a credible abuse report from a third party (such as a DMCA notice, a law enforcement tip, or a network abuse complaint from another service provider), we will investigate and may take immediate action to suspend or terminate the account in question.
Where we identify or receive reports of a suspected violation, we may:
- Suspend your account immediately pending investigation
- Request information from you to clarify the nature of your use
- Permanently terminate your account if a violation is confirmed
- Report the matter to law enforcement or regulatory authorities
- Seek compensation for damages caused to our infrastructure, reputation, or other customers
7. Abuse Reporting
If you believe our Service is being used in violation of this AUP, please report it to [email protected]. Please include as much detail as possible, including any relevant IP addresses, timestamps, log extracts, or other supporting evidence. We take abuse reports seriously and will investigate all credible reports promptly.
8. Changes to This AUP
We may update this AUP at any time. Material changes will be communicated via email at least 14 days before they take effect. Continued use of the Service after the effective date of any update constitutes acceptance of the revised AUP.
